In order to obtain a fiance visa, or a K-1 nonimmigrant visa, you must be a U.S. citizen and intend to marry your fiance within 90 days of their entrance to the U.S. You must be legally free to marry and have met each other in person at least once within the last two years. The application process entails filing a petition asking USCIS to recognize your relationship, submitting documentation showing the relationship is real, and applying for a visa. If granted, the visa is valid for up to six months. After your fiance is admitted into the U.S. and the marriage takes place, your new spouse may apply for a Green Card.
Obtaining a fiance visa comes with several benefits. Children who are under 21 years old and unmarried are eligible for a K-2 visa, which allows them to accompany their parent to the U.S. and apply for Green Cards as well. Your fiance may also apply for work authorization after entering the U.S., allowing them to take a job while waiting for their Green Card application to be processed. Note that in order to receive these benefits and remain in the U.S., your marriage must take place within 90 days; otherwise, your fiance may be deported. If you and your fiance are suspected of marriage fraud, you may be investigated by U.S. Immigration and Customs Enforcement and asked to provide additional paperwork demonstrating the validity of your relationship. It is therefore important to follow all guidelines and rules when applying for a visa.
